What is a McKenzie Friend?

A McKenzie Friend is someone who supports a litigant in person during Family Court proceedings.

 

This support may include:

  • Helping you understand the court process and procedure

  • Assisting with preparation and organisation

  • Providing quiet support during hearings, where permitted by the court

 

McKenzie Friends do not act on the court record or speak on your behalf in proceedings.

Child Arrangements Order cases

A significant proportion of our McKenzie Friend work relates to Child Arrangements Order proceedings.

 

Support is often structured around the usual Family Court pathway, which may include:

  • The First Hearing (FHDRA)

  • Any interim or directions hearings

  • The Final Hearing

The scope of support is agreed in advance and depends on the needs and complexity of your case.

Barrister strategy conference

For Child Arrangements Order cases that involve allegations or contested issues, a conference with a family law barrister is automatically included as part of our McKenzie Friend support.

 

This conference focuses on:

  • Understanding the legal framework of your case

  • Identifying strengths and weaknesses

  • Considering how allegations may be approached

  • Preparing strategically for upcoming hearings

 

For cases outside of Child Arrangements Order proceedings, or where a barrister conference is not automatically included, we may still be able to arrange a barrister conference separately, subject to suitability and availability.

 

The barrister does not attend court or act on the record. The conference is provided for strategic guidance only.

  • Fees are agreed in advance based on the scope and complexity of the work

  • Payment plans may be available, depending on circumstances

  • We can also assist on an ad-hoc basis, for example, with document preparation, statement support, or hearing preparation

 

All arrangements are discussed openly before any work is undertaken.

Important clarification – fact-finding hearings

Fact-finding hearings are not included within standard McKenzie Friend support arrangements.

 

If a fact-finding hearing is ordered, this is treated as separate work, and any support relating to fact-finding is discussed and agreed independently.
